Acceptance of Terms

By enrolling in lessons at Ahorita Spanish School, you agree to abide by these Terms and Conditions. Please read them carefully, as they govern your participation in our lessons and use of our services.

1. Introduction

Welcome to Ahorita Spanish School. These Terms and Conditions (“Terms”) govern your access to and use of our website and the online Spanish language instruction and related services provided by Ahorita Spanish School (“we,” “us,” or “our”). Our services include live lessons delivered via Zoom, course content and assignments delivered through Google Classroom, educational materials (worksheets, audio, readings, and interactive activities), and the Free Trial consisting of three (3) complimentary lessons.
By accessing or using our website or services, enrolling in a course, or participating in the Free Trial, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our website or services.

1.1 Scope

These Terms apply to all users of our services, including prospective and current students, trial users, instructors, and visitors. Additional policies (including our Privacy Policy and any Refund or Cancellation Policy) are incorporated by reference and form part of these Terms.

1.2 Change to the Terms

We may update these Terms from time to time. Updated Terms will be posted on our website with a new Effective Date and notified through e-mail; continued use of our services after posting constitutes acceptance of the revised Terms.

1.3 Authority to enroll

If you are enrolling on behalf of another person, you represent that you have the legal authority to do so.

2. Eligibility

To enroll in and participate in our courses, you must meet the following requirements:

2.1 Minimum Age

You must be at least 18 years old at the time of enrollment. We primarily serve adults; while we may accept students aged 16–17, all communication regarding enrollment, scheduling, and course progress will be conducted through a parent or legal guardian who is at least 18 years old. However, our materials and lessons are designed for adult learners.

2.2 Language Requirements

Our courses are designed for learners of Spanish as a foreign or second language, focusing on Mexican Spanish, but also covering other Spanish variants when relevant. No previous Spanish knowledge is required for beginner-level courses. Also, all of our instructors have a strong command of English to ensure clear communication and support for students throughout the learning process.

2.3 Technical Requirements

You must have access to:
  • A stable internet connection capable of supporting video conferencing.
  • A device (computer, tablet, or smartphone) with Zoom installed.
  • A valid email address for communications and access to Google Classroom and e-mail communication.

2.4 Payment and Registration

Enrollment is complete only after:
  • You have participated in the Free Trial.
  • You have received and paid the PayPal invoice for your chosen plan.

2.5 Compliance

You agree to comply with these Terms and any additional policies or guidelines provided by Ahorita Spanish School.
We reserve the right to refuse service to anyone who does not meet these eligibility requirements or who violates these Terms.

3. Plans and Services

Ahorita Spanish School offers online Spanish language instruction through the following plans:

3.1 Solo Plan

  • Description: One-on-one private lessons tailored to the student’s pace and goals.
  • Pace Options: Tranquilo (light), Regular, or Intensivo (intensive).
  • Class Duration: Live online lessons of 50 per session.
  • Included Services: Access to Google Classroom, extra learning materials (worksheets, audio, readings, interactive activities), and homework assignments.
  • Free Trial: Three (3) complimentary lessons per student prior to payment.

3.2 Duo Plan

  • Description: Private lessons for two students who already know each other (e.g., friends, partners, siblings).
  • Pace Options: Tranquilo (light), Regular, or Intensivo (intensive).
  • Class Duration: Live online lessons of 50 per session.
  • Included Services: Access to one shared Google Classroom account for the pair, extra learning materials (worksheets, audio, readings, interactive activities), and homework assignments.
  • Free Trial: Three (3) complimentary lessons offered jointly to both students prior to payment.

3.3 Team Plan

  • Description: Small group classes with 3 to 6 students matched by level and availability.
  • Group Formation: A new group is formed once at least three students are ready to begin; students will be notified by email.
  • Class Duration: Live online lessons of 50 per session.
  • Included Services: Access to one shared Google Classroom account for the group, extra learning materials (worksheets, audio, readings, interactive activities), and homework assignments.
  • Free Trial: Three (3) complimentary lessons conducted collectively for all students in the group (three free lessons) prior to payment.

3.4 General Conditions for All Plans

  • Classes are delivered exclusively online via Zoom.
  • All lesson content, materials, and assignments are for educational purposes only and may not be shared, reproduced, or sold without prior written consent.
  • We reserve the right to make reasonable modifications—previously discussed with the student—to the services, schedule, or materials to improve the learning experience.

4. Free Trial Policy

4.1 Purpose

The Free Trial is intended to allow prospective students to experience our teaching method, class format, and materials before committing to a paid plan. Each eligible student may receive up to three (3) complimentary lessons as part of the Free Trial.

4.2 Eligibility

  • The Free Trial is available once per individual or group, depending on the chosen plan (Solo, Duo, or Team).
  • Students must meet the eligibility requirements described in Section 2.

4.3 Scheduling and Attendance

  • Free Trial lessons are scheduled by mutual agreement based on the availability of both the student(s) and the instructor.
  • Students must notify the school of any cancellation or rescheduling request at least twelve (12) hours in advance.
  • No-shows or cancellations made with less than twelve (12) hours’ notice—except in cases of documented emergencies—will result in the forfeiture of that trial lesson.
  • Students arriving more than fifteen (15) minutes late to a scheduled trial lesson will be considered absent, and the lesson will be forfeited.

4.4 Conduct

  • Students are expected to attend all scheduled trial lessons on time and prepared, with a stable internet connection and required materials.
  • The same behavioral and participation expectations apply to Free Trial lessons as to paid lessons (see Section 8: Student Conduct).

4.5 No Obligation and Next Steps

Completion of the Free Trial does not obligate the student to purchase a paid plan. However, to continue lessons beyond the Free Trial, the student must select a plan, receive a PayPal invoice, and complete payment prior to scheduling additional lessons.

5. Booking and Scheduling

5.1 Scheduling of Lessons

  • Lessons are scheduled by mutual agreement between the student(s) and the instructor, based on availability.
  • For the Solo Plan, the schedule is flexible and arranged individually with the student.
  • For the Duo Plan, both students must agree on the same schedule before lessons are confirmed.
  • For the Team Plan, schedules are set for the group as a whole based on fixed time slots established by Ahorita Spanish School or on the most compatible schedule for the majority of the students registered in the group. Once confirmed, schedules cannot be changed for individual students.

5.2 Rescheduling and Cancellations

  • Students must provide at least twelve (12) hours’ notice to cancel or reschedule a lesson, except in cases of documented emergencies.
  • Lessons cancelled or rescheduled with less than twelve (12) hours’ notice will be considered missed and cannot be rescheduled or refunded.
  • No-shows will be counted as a missed lesson.

5.3 Emergencies

  • An emergency is defined at the sole discretion of the instructor or Ahorita Spanish School.
  • Documentation or reasonable explanation may be requested to validate the emergency.

5.4 Maximum Number of Rescheduled Lessons per Package

  • 5-lesson packages: maximum 1 rescheduled lesson.
  • 10-lesson packages: maximum 3 rescheduled lessons.
  • 20-lesson packages: maximum 4 rescheduled lessons.
  • Rescheduled lessons must be taken within the original validity period of the package or at the end.

5.5 Plan-Specific Rescheduling Conditions

  • Solo Plan: Rescheduling is possible when both the student and the instructor agree.
  • Duo Plan: Rescheduling is possible only when both students and the instructor agree.
  • Team Plan: Lessons proceed as scheduled even if one or more students are absent. In exceptional cases, a class may be rescheduled only if all enrolled students and the instructor agree. If rescheduling is not possible, the class may be recorded for absent students to review later.

5.6 Punctuality

  • Students arriving more than fifteen (15) minutes late to a scheduled lesson will be marked absent, and the lesson will be forfeited.
  • The instructor will remain online for at least the first 15 minutes of the scheduled lesson time.

5.7 Instructor Cancellations

  • If a lesson is cancelled by the instructor for any reason, the lesson will be rescheduled at no additional cost to the student.

6. Payments and Pricing

6.1 Payment Method

  • Payments can be made via PayPal or, for students with a bank account in Mexico, via bank transfer in Mexican Pesos (MXN) to the account provided by Ahorita Spanish School.
  • A payment link (for PayPal) or bank transfer instructions will be sent to the student once the Free Trial (if applicable) is completed and the student has confirmed their selected plan and schedule.

6.2 Payment Due Date

  • Payment must be completed in full before any paid lessons are scheduled.
  • Lessons will not be reserved or delivered until payment is received.

6.3 Currency

  • All PayPal payments are processed in United States Dollars (USD), unless otherwise specified in writing.
  • Bank transfers within Mexico are processed in Mexican Pesos (MXN) at the exchange rate agreed upon at the time of invoicing.
  • Students are responsible for any bank charges, currency conversion fees, or PayPal transaction fees.

6.4 Refund Policy

  • Payments are non-refundable, except where required by law.
  • No refunds are provided for missed lessons, late arrivals, or unused lessons within a purchased package.
  • In exceptional cases (e.g., verified medical emergencies), partial credit towards future lessons may be granted at the sole discretion of Ahorita Spanish School.

6.5 Package Validity

  • All lesson packages must be used within the following time frames from the first paid lesson:
    • 5-lesson packages: 1 week
    • 10-lesson packages: 2 weeks
    • 20-lesson packages: 4 weeks
  • Unused lessons after the validity period will be forfeited.

6.6 Price Changes

  • Ahorita Spanish School reserves the right to update prices at any time. Any price changes will not affect packages that have already been paid in full.

7. Learning Materials

7.1 Access to Google Classroom

  • Students in the Solo Plan will receive access to an individual Google Classroom account for their course.
  • Students in the Duo Plan and Team Plan will receive access to a shared Google Classroom for their class.
  • Access will be granted after enrollment and payment are complete, and will remain active 16 weeks after the package validity period ends.

7.2 Included Learning Materials

  • Materials may include worksheets, homework assignments, audio recordings, readings, and interactive activities.
  • All materials are designed for educational use within the context of Ahorita Spanish School courses.

7.3 Usage Restrictions

  • Students may download and use the materials for their personal learning only.
  • Sharing, reproducing, distributing, selling, or publishing the materials—whether in physical or digital form—without prior written permission from Ahorita Spanish School is strictly prohibited.
  • Google Classroom credentials may not be shared with individuals who are not enrolled in the corresponding course.

7.4 Intellectual Property

  • All course content, including but not limited to lesson plans, written materials, audio, video, graphics, and interactive activities, is the intellectual property of Ahorita Spanish School or its instructors and is protected by copyright law.
  • By enrolling in a course, students do not acquire any ownership rights over the materials.

7.5 Termination of Access

  • Access to Google Classroom will be removed once the period indicated at the beginning of this section is completed.
  • Ahorita Spanish School reserves the right to revoke access in cases of misuse, breach of these Terms, or violation of intellectual property rights.

8. Student Conduct

8.1 General Behavior

  • Students are expected to maintain respectful and professional behavior toward instructors, classmates, and any other participants during lessons and in all communications related to the course.
  • Disruptive, offensive, or inappropriate conduct—whether verbal, written, or visual—will not be tolerated and may result in suspension or termination of services without refund.

8.2 Punctuality and Preparedness

  • Students must join the lesson on time and be ready to participate with all necessary materials.
  • Lessons will not be extended to make up for time lost due to late arrival.
  • Students arriving more than fifteen (15) minutes late will be marked absent, as stated in Section 5.

8.3 Technical Requirements

  • Students must ensure they have a stable internet connection, functioning audio and video, and access to Zoom before the lesson starts.
  • Technical issues on the student’s side (e.g., poor connection, device malfunction) will not be considered grounds for a free make-up lesson. However, rescheduling may be considered at the instructor’s sole discretion, but only if the issue occurred within the first 15 minutes of the session.

8.4 Participation

  • Active participation is encouraged and expected in all lessons, including completing assigned homework and engaging with Google Classroom materials.
  • In group settings (Duo or Team Plans), students must allow equal participation opportunities for all members.

8.5 Use of Cameras and Microphones

  • Students are required to have their camera turned on during lessons unless agreed otherwise with the instructor.
  • Microphones should remain muted when not speaking to avoid background noise, except during interactive segments.

8.6 Prohibited Actions

  • Recording lessons (audio, video, or screenshots) without prior written consent from Ahorita Spanish School is prohibited.
  • Sharing Zoom links or Google Classroom access with individuals not enrolled in the course is strictly forbidden.

8.7 Consequences of Misconduct

  • Violation of these conduct rules may result in warnings, suspension, or permanent removal from the course without refund, at the sole discretion of Ahorita Spanish School.

9. Age Policy

9.1 Minimum Age Requirement

  • Enrollment is open primarily to adult learners aged 18 years and older.
  • Students aged 16–17 may be accepted at the discretion of Ahorita Spanish School, provided they demonstrate sufficient maturity and readiness to participate in an adult learning environment.

9.2 Parental or Guardian Consent for Minors

  • For students aged 16–17, written consent from a parent or legal guardian is required prior to enrollment.
  • The parent or guardian must acknowledge that the school’s materials and teaching approach are designed for adult learners.

9.3 No Specialized Teen Materials

  • Ahorita Spanish School does not offer curricula specifically designed for minors. Lessons for students aged 16–17 will follow the same content and methodology as adult classes. However, required topics may be adapted at the instructor’s discretion to better suit the age and maturity level of the student.

10. Intellectual Property

10.1 Ownership of Content

  • All lesson materials, course content, lesson recordings (if applicable), graphics, worksheets, audio, video, readings, interactive activities, website content, and any other educational resources provided by Ahorita Spanish School are the exclusive property of Ahorita Spanish School.
  • All such materials are protected by applicable copyright, trademark, and intellectual property laws.

10.2 Limited License

  • Upon enrollment, students are granted a non-exclusive, non-transferable, and revocable license to access and use the materials solely for their personal educational purposes during the course.
  • This license does not grant ownership or any rights to reproduce, distribute, sell, or publicly display the materials beyond what is expressly allowed.

10.3 Prohibited Uses

  • Students may not share, publish, distribute, or make available any lesson recordings, Zoom links, Google Classroom access, or materials to third parties.
  • Commercial use, resale, or adaptation of the materials without prior written consent from Ahorita Spanish School is strictly prohibited.

10.4 Prohibited Uses

  • Recording of lessons (audio, video, or screenshots) is prohibited unless expressly authorized in writing by Ahorita Spanish School.
  • For the Team Plan, lessons may be recorded only by the instructor in cases where a student cannot attend, and such recordings will be made available exclusively to the enrolled members of that group.
  • Any authorized recordings remain the sole property of Ahorita Spanish School and may not be copied, downloaded, or shared outside the authorized group.

10.5 Enforcement

  • Any breach of this Intellectual Property section may result in immediate termination of access to services without refund, and legal action may be taken where appropriate.

11. Privacy and Data Protection

11.1 Collection of Personal Data

  • Ahorita Spanish School collects only the personal data necessary to provide educational services, including but not limited to: name, contact information (email or social media if applicable), course history, payment records, and relevant learning information (level, learning goals, scheduling preferences).
  • All payment transactions are processed through secure third-party payment processors; Ahorita Spanish School does not store credit or debit card details.

11.2 Use of Personal Data

  • Personal data is used solely for:
    • Managing enrollment and class scheduling.
    • Processing payments and issuing receipts or invoices.
    • Communicating with students regarding classes, policies, and promotions.
    • Improving the quality of teaching and student experience.

11.3 Data Sharing and Disclosure

  • Ahorita Spanish School does not sell, rent, or trade student information to third parties.
  • Personal data may be shared only in the following cases:
    • With instructors for the sole purpose of providing the lessons.
    • As required by law or legal process.
    • With service providers (e.g., Zoom, Google Workspace, payment processors) strictly for operational purposes.

11.4 Data Protection Measures

  • Personal data is stored in secure, password-protected systems with restricted access.
  • Reasonable administrative, technical, and physical safeguards are implemented to protect information against loss, theft, unauthorized access, disclosure, alteration, or destruction.

11.5 Student Rights

  • Students have the right to:
    • Access, update, or correct their personal data.
    • Request deletion of their personal data, subject to legal or contractual retention requirements.
    • Withdraw consent for data processing, provided it does not affect the provision of contracted services.

11.6 Retention of Data

  • Personal data will be retained only for as long as necessary to fulfill the purposes for which it was collected, or as required by applicable laws.

11.7 Consent

  • By enrolling in Ahorita Spanish School, students consent to the collection, use, and storage of their personal data as described in this section.

12. Limitation of Liability

12.1 Results Disclaimer

  • Ahorita Spanish School does not guarantee specific learning outcomes, fluency levels, or exam results, as these depend on each student’s personal effort, attendance, practice outside of class, and learning style.

12.2 Internet and Technical Issues

  • The school is not responsible for interruptions, delays, or cancellations caused by the student’s internet connection, device malfunctions, or other technical issues outside the school’s control.
  • Instructors will make reasonable efforts to reschedule or recover lost time only if the issue originates from the school’s side.

12.3 Third-Party Tools and Services

  • Lessons may involve the use of third-party platforms or tools (e.g., Zoom, Google Workspace, Genially). While the school selects reliable services, it is not liable for any service outages, security breaches, or other issues beyond its control related to these tools.

12.4 Limitation of Damages

  • To the fullest extent permitted by law, Ahorita Spanish School’s total liability for any claim arising out of or relating to its services shall not exceed the total amount paid by the student for the affected course.

13. Media and Promotional Use

  • Ahorita Spanish School may, with prior notice, record short sections of live lessons for promotional purposes. All such recordings will ensure the anonymity of students by avoiding the use of full names, identifiable images, or personal information without explicit consent.
  • Any reviews, testimonials, or comments posted by students on our social media platforms or other public channels may be used by Ahorita Spanish School for promotional purposes, both online and offline, without additional compensation.

14. Amendments to Terms

14.1 Right to Modify

  • Ahorita Spanish School reserves the right to update, modify, or revise these Terms and Conditions at any time in order to reflect changes in policies, legal requirements, or operational needs.

14.2 Notification of Changes

  • Students will be notified of any changes via email and/or through the school’s official communication channels (e.g., website announcements, student platform).
  • Changes will take effect at least 3 calendar days after notification, unless immediate modifications are required by law or for security reasons.

14.3 Continued Enrollment

  • By continuing to attend classes after the effective date of any changes, students are deemed to have accepted the updated Terms and Conditions.
